EU APPOINTED PERSON SERVICE UNDER THE GPSR TERMS & CONDITIONS

By purchasing your EU Appointed Person Service via checkout, you are agreeing to be bound by the terms in full without variation.

1. Introduction
These Terms set out how you (the customer) can purchase and use the EU Appointed Person service from Kate Kurdziej of Olivier Consultancy, based in Spain. Please take the time to read them carefully. We’re committed to providing a transparent and supportive experience for all our clients.

2. What the Service Includes
Our service includes acting as your EU Appointed Person for compliance and safety matters under the GPSR. If we are contacted regarding issues outside this scope – such as customs or VAT – an admin fee of €85 may be applied, plus any further related costs. You are responsible for all external duties and fees.

3. When Representation Begins
Representation does not begin at the point of purchase. You must submit all required documentation and have it reviewed and approved before Olivier Consultancy can be listed as your EU Appointed Person.

4. Product Safety & Risk Assessments
You remain fully responsible for the safety and compliance of your products. You agree to conduct appropriate risk assessments and complete all documentation truthfully in line with GPSR expectations. By using this service, you confirm you understand this and agree to indemnify us against any legal claims or costs connected to your products.

5. Your Ongoing Responsibilities
You are responsible for keeping all compliance-related information up to date and notifying us of any changes to your products, business operations, or supply chain that may affect representation. You agree that the service extends only to the products which we hold on file for you.

6. Our Right to Decline or Withdraw
We reserve the right to decline representation if your product or business falls outside our remit or poses excessive risk. In that case, your subscription will be cancelled and refunded. We may also withdraw representation at any time if compliance standards are not maintained. No refund will be given in this situation.

7. Jurisdiction Changes & Scope Adjustments
We may update or adjust the product types or jurisdictions we support. If representation must be withdrawn, we will provide as much notice as possible. However, we are not liable for any resulting costs or disruption to your business.

8. Handling Non-GPSR Issues

Should we be contacted in relation to matters beyond the scope of GPSR – such as customs documentation errors or VAT issues – we may charge an initial administrative fee of €85, plus any time or resources required to resolve the matter.

9. Access to Digital Resources & Refund Policy
When you sign up, you receive immediate access to our digital guidance portal. By purchasing, you consent to access this content straight away and waive your right to cancel or request a refund if you change your mind.

10. Annual Subscription & Renewals
This is an annual subscription that renews automatically. You’ll be sent a reminder by email before your renewal date however it remains your responsibility to receive this email and be aware of the renewal date. If you wish to cancel, please do so at least 5 working days before renewal to avoid being charged.

11. Pricing Changes
We may increase our fees annually and will give you a minimum of 28 days’ notice. If you choose not to continue, we will agree on a final representation date with you.

12. No Partial Refunds
Once your representation begins, the service runs for a 12-month term. If you cancel midway through, no partial refunds will be given. We will, however, update our records to reflect your status.

13. Intellectual Property
All materials provided – including forms, guides, and portal content – remain the intellectual property of Olivier Consultancy. You are granted a non-exclusive, non-transferable licence to use these materials for your business only. You must not copy, adapt, share, or distribute them. Breaches may result in service termination and legal action.

14. Tech Support & Refund Requests
If you experience issues accessing your digital content, email us at hello@olivier-consultancy.com with “GPSR” in the subject line.

If you believe you are entitled to a refund outside the terms outlined above, please email us explaining your situation. All refunds are considered in line with your statutory rights.

These terms are governed by the laws of England and Wales. Any disputes will be handled exclusively by the English courts.
