If you sell digital products online and have customers in the EU, you might have seen whispers (or panicked posts) about the new EU General Product Safety Regulation (GPSR).
One question that keeps coming up is: Do I need an EU appointed person for digital products?
The answer? It depends, but for many non-EU businesses, the answer is yes if you intend to sell into the EU.
Let’s break it down in plain English so you can understand your obligations without needing a law degree.
What Is the EU GPSR?
The General Product Safety Regulation (GPSR) came into enforcement on December 13th 2024 and replaces the older General Product Safety Directive.
It applies to all products sold to EU consumers and yes, this has been confirmed to include digital goods.
The GPSR was created to reflect the way we now shop- across borders, via marketplaces, direct to consumer and with digital products and services that accompany physical ones.
What Is an EU Appointed Person?
An Appointed Person (sometimes called an EU Responsible Person or Authorised Representative) is a legal requirement under the GPSR for non-EU businesses that sell products to EU consumers.
This person (or company) acts as your point of contact for EU market surveillance authorities and helps ensure your product complies with the relevant safety regulations. They must be based in the EU.
So, Do You Need One for Your Business?
Here’s a quick checklist:
✅ Are you based outside the EU?
✅ Do you sell digital products?
✅ Do you want to ensure your business is legally protected when selling into the EU to avoid fines?
If you tick all of those it’s smart to get an EU Appointed Person in place now, before it becomes an issue. Some platforms may already be rejecting listings or asking for proof of compliance- this is a new law which is unfolding right now.
What Happens If You Don’t Appoint One?
Failure to comply with GPSR could lead to:
- Removal of your products from EU-facing platforms or marketplaces
- Fines or sanctions under EU consumer law
- Loss of trust from EU customers and partners
- Being blocked from selling into the EU market altogether
