What is the General Product Safety Regulation (GPSR) and How Does it Affect Your Digital Products and Free Downloads?

If you are based outside of the European Union (EU) and you sell digital products online to customers in the EU then you need to know about the General Product Safety Regulation (GPSR).

This new law, which came into force in December 2024, applies to all products sold to EU consumers including digital downloads and online resources.

Yes, even if your products are completely digital, you still need to comply.

For many online business owners outside of the EU, this regulation has flown under the radar but ignoring it could lead to legal issues, product bans, and lost revenue.

What is the GPSR?

The General Product Safety Regulation (GPSR) replaces the old General Product Safety Directive (GPSD) and is designed to ensure that all products sold in the EU meet high safety standards. This includes digital products such as:

  • Online courses & memberships
  • Ebooks & templates
  • Digital planners & printables
  • Software & apps
  • AI-generated tools

Under the new rules, if you sell digital products to customers in the EU, you must ensure they are safe, transparent, and compliant.

How Does the GPSR Apply to Digital Products?

Many digital product sellers assume that safety regulations don’t apply to them after all, they’re not selling physical goods. But under the GPSR, digital products must meet certain safety standards, including:

Clear instructions – Ensuring customers understand how to use your product properly

No misleading claims – Transparency about what your product does and does not do

No risk of harm – Avoiding deceptive or harmful functionalities (e.g., AI bias, misleading algorithms)

Compliance documentation – Having an appointed representative within the EU

If your business is based outside of the EU but sells to EU consumers, you are legally required to have an EU-based representative to ensure compliance with these rules.

What Happens if You Don’t Comply?

Failure to comply with the GPSR could result in:

  • Product bans in the EU market
  • Fines or legal penalties
  • Refund demands from customers
  • Reputational damage that impacts future sales

Many digital business owners are only now realising how these laws affect them and struggling to find a solution.
